Article 12 of the United Nations Convention on the Rights of People with Disabilities (CRPD) refers to the legal capacity and equal recognition before the law of people with disabilities. Legal decisions and actions should be based on the choice and will of the person with disability rather than what someone else considers to be their best interest.
All the States which have signed the CRPD have the obligation to take measures to ensure that people with disabilities can exercise their legal capacity. The CRPD is not well known in France despite having numerous repercussions on the daily life of people with disabilities.
In order to initiate a collective debate on the implications of the CRPD and its Article 12 in France, Collectif Contrast has been created. Composed of a group of academic researchers and a steering committee, in which Inclusion Europe French member UNAPEI takes part, Collectif Contrast aims at triggering a collaborative dialogue with persons with disabilities. The first step towards this participative approach is the organization of an international conference taking place in Paris on 28-30 October. The conference will gather academic researchers, professionals from the field, users and their representatives as well as members of the civil society. The collaborative process initiated at the conference will be pursued in 2016 with the support of the steering committee and official instances monitoring the Convention. Together, they will be able to provide guidance to ensure the respect of the rights and preferences of people with disabilities.
This conference will allow participants to discover which legal and administrative tools exist to guarantee the legal capacity of people with disabilities and know more about their use and effectiveness in the social and institutional context of France.
